| 内容記述 | 預言者ムハンマドの教友の法判断は、神の啓示や預言者ムハンマドの言行を解釈するための資料として、初期スンナ派法学では啓典や預言者のスンナに次いで重んじられた法源の1つであった。しかしこれまでの研究で明らかにされているように、スンナ派4法学派の中でもシャーフィイー派は教友の法判断の法源性を否定することを通説とした唯一の学派であるとされたこともあり、同学派において教友の法判断がどのように活用されたかに関しては十分に解明されていない。本稿では14世紀のアラーイーとザルカシーの著作から、11世紀以前の初期シャーフィイー派法理学説における教友の法判断の法理学上の機能に関する論争を掘り起こす。この法理学論争の分析を通じて本稿では、主キヤースの強弱・優先関係の入れ替えに与える教友の言説の判例としての規範性と機能の有無に関する議論が交わされていたことを具体的な実定法の例を踏まえて明らかにする。 | |||||

| 内容記述 | In the early Sunni school, the saying of the Companion of the Prophet Muḥammad (alṢaḥābī) have been used as legal proof (ḥujja) for interpreting the revelations of Allāh and the words and deeds of the Prophet. As the research so far has revealed, the Shafi‘ī school is the only school among the four major Sunni schools that has denied the normativity of the opinion of the Companion as a legal proof. However, it is not fully understood how the legal judgments of the Companion have been utilized in this school also. This article investigates the controversy over the legal function of the Companion's legal judgment in the early Shafi‘ī school before the 11th century from the writings of Salāḥ al-Dīn al-‘Alā’ī and Badr al-Dīn al-Zarkashī in the 14th century. Through an analysis of this controversy, I will clarify how the saying of the Companion has been considered to change the precedence and priority of legal analogies (qiyāsāt) as a normative judicial precedent in this school. | |||||
