| 内容記述 | 本稿の問いは精神薄弱者福祉法に対象規定がないのはなぜかである。従来の解説では，知能検査の信頼性の低さをその理由とすることが一般的である。しかし，精神薄弱児・者が問題として把握されること自体が，知能検査へのある程度の信頼なしに成立しないから，別の理由があると考えた。本稿では，精神薄弱者福祉法の制定過程を検討した結果，概算された知的障害者の数が非常に多いにもかかわらず，提供しうる社会資源が極めて貧弱であることが対象規定を欠落させたまま法の成立へと至った要因であると結論付けた。最後に一連の法制定過程を社会モデルの観点から評価した。そして，精神薄弱者福祉法制定にあたっては，客観的な指標のために医学や心理学が用いられるというよりも，政策立案や運営上の都合を粉飾するために動員されたと考察した。 | |||||||||||

| 内容記述 | The question of this paper is why there is no targeted provision in the Act on Welfare of Mentally Retarded Persons. Conventional commentaries typically attribute this to the low reliability of intelligence tests. However, I consider another reason to be the fact that identifying someone as a Intellectual disabled child or person is, itself, not possible without a certain degree of trust in intelligence tests. This paper examines the process of the enactment of the Act on Welfare of Mentally Retarded Persons and concludes that although the estimated number of mentally retarded people is exceptionally large, the social resources provided for them are extremely meager, which is a factor that led to the enactment of the law without targeted provision. Finally, I evaluated the series of legislation processes from the perspective of a social model. It showed that medicine and psychology were not used for objective indicators, but were mobilized to justify policy-making and operational speculation. | |||||||||||
