| 内容記述 | ウズベキスタンにおいては、不公正な取引方法は、Law on CompetitionおよびRules of Retail Merchandizing in the Republic of Uzbekistanという二つの法律により規制されており、その規制が分散的、断片的という特徴を有している。Law on Competitionはそれを不公正な競争として禁止していることに対し、Rules of Retail Merchandizingはそれを違法な取引として捉えている。そして、不公正な取引方法は、Law on Competitionにおいて、同法に規制されるほかの競争制限的行為との区別が必ずしも明確とはいえない状況にある。本論文は、不公正な取引方法に対する有効なエンフォースメントを行うための課題を指摘した上、解決策を提案したものである。 | |||||||||||

| 内容記述 | Regulations of unfair Trade practices(UTP) in Uzbekistan have a fragmented feature. "Law on Competition" and "Rules of Retail Merchandizing in the Republic of Uzbekistan" contain different provisions on unfair Trade practices. The former categorizes UTP as unfair competition while the latter as illegal trade. Moreover, UTP are not clearly distinguished from other categories in Law on Competition. The regulatory approach of UTP in Uzbekistan lacks a clear legal framework and enforcement mechanisim. This article aims to provide structural suggestions to improve the regulatory and enforcement system in Uzbekistan in order to effectively deal with the issue of UTP. | |||||||||||
