| 内容記述 | アメリカにおいては、現在でも多くの被害者を発生させる大規模不法行為が発生している。そこで、人身損害への賠償が派生させる問題について、塡補賠償と懲罰的賠償の側面から検討を行った。その結果、特に有毒物質不法行為の場合には、塡補賠償を得るためには疾病の潜伏性から疾病発見を目的とする医療検査賠償が困難となっている。また、懲罰的賠償に関しては、大規模不法行為の領域では成立要件である害意が緩和されていることが理解できる。 | |||||||||||

| 内容記述 | A mass tort occurred in US can harm large number of people with distinct and latent personal injuries. Analyzing the types of damages which can be awarded in mass tort cases, two areas of damages have some special play, comparative damages and punitive damages. The courts has heisted to award damages for fear and medical monitoring in comparative damages because the harm and disease is latent. Many mass tort cases seek punitive damages, and they are frequently awarded. The awards may result from the appearance of a greater degree of wrongdoing which is not the same as malice if there is a widespread injury. | |||||||||||
