Non-international armed conflict has the dual nature of law enforcement and hostilities. Nevertheless, the law enforcement paradigm is not competent for armed confrontation at sea with non-international armed conflict with such insurgents, because of some insurgents, like LTTE, have advanced capabilities to fight naval warfare. In conclusion, at that case through the application of the law of armed conflict, excluding the prize law, under the paradigm of hostilities, foreign vessels are not only attacked but also
