| 内容記述 | 南シナ海の諸地形に対する中国の「歴史的権利」をめぐり、フィリピンと中国との間で生じていた紛争について、2013年1月、フィリピンは、国連海洋法条約附属書VIIに基づく仲裁手続に付託した。2016年7月、仲裁裁判所は、中国が根拠としてきた南シナ海の広大な海域を囲む「九段線」を、海洋法条約に違反し無効と判示した。本稿は、歴史的水域と歴史的権利の観点から、九段線の法的地位を分析するものである。 | |||||||||||

| 内容記述 | On January 22, 2013, the Philippines submitted its disputes with China over the Spratly Islands to arbitration under Annex VII of the United Nations Convention on the Law of the Sea (UNCLOS). The Philippines asked the arbitration tribunal to declare that water area establishment based on the nine-dash line violates UNCLOS. On July 12, 2016, the arbitration tribunal handed down a decision that favored the Philippines' claims, ruling that there was no legal basis for China to claim historic rights to resources within the sea areas falling within the "nine-dash line." This article deals with this issue from the viewpoint of historic waters or historic rights. | |||||||||||
