Under such ruling, a claimant of insurance benefit does not have to prove that the accident is not caused by sickness of the insured. It changed the former case law and an insurer bears the burden of proof on a fact that accident is caused by sickness of insured. But after this conversion of burden of proof, other difficult practical problems are arising, particularly in cases of death of insured by aspiration or drowning during bathing etc. This article aims to analyze recent cases on the
