review)","bibliographic_titleLang":"en"}]}]},"item_1_description_12":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"少年法は、1948年に成立し、施行後50年余りの間改正されなかったが、2000年、2007年、2008年、2014年と相次いで4回改正された。そして2017年には、少年法の適用年齢の引下げの是非が改正論議の俎上に載り、法制審議会での検討課題となっている。問題は、同法の適用年齢が18歳未満に引下げられると、18歳と19歳の未成年者が「成人」として刑事処分を受けることになるが、いまだ人格形成が未成熟な同年齢層の若年者に対する刑事手続や刑事政策的措置は成人に対する場合と同様に適用・運用すればよいのか、それとも、引下げを行わず、少年法の「少年の健全育成」の理念を維持し、教育的・福祉的処遇により更生・社会復帰を目指すかにある。犯罪被害者やその家族・遺族(以下、「被害者等」という。)の権利利益の擁護の策が講じられ、特に2004年の犯罪被害者等基本法、2005年の犯罪被害者等基本計画の策定後は被害者等の権利・利益の擁護に向けた法改正や立法が相次いだ。これにより、従来、被害者等への配慮の視点が欠けていた少年法の領域においても、被害者等による少年審判の傍聴や、審判記録の閲覧・謄写等の被害者等への配慮の規定が整備されるようになり、被害者等への配慮の視点が不可欠となっている。本稿は、この視点から、少年法の適用年齢引下げの是非論を検討するものである。","subitem_description_language":"ja","subitem_description_type":"Abstract"}]},"item_1_description_13":{"attribute_name":"内容記述","attribute_value_mlt":[{"subitem_description":"瀬川晃教授古稀記念論集","subitem_description_language":"ja","subitem_description_type":"Other"},{"subitem_description":"Dedicated
