| 内容記述 | 本稿は、信託を題材に、国際的な事案において相続代替制度(相続法の規律の枠外で行われる世代を超えた財産承継のための法制度)を活用してなされる財産承継の法的な処理を抵触法的観点から検討するものである。まず相続代替制度について概説し、続けて信託の準拠法に関する議論を整理した上で、信託準拠法と相続準拠法との適用関係を考察し、最後に相続代替制度としての信託準拠法を特別に考慮する必要性があるか否かについて現時点における一定の結論を示した。 | |||||||||||||

| 内容記述 | This paper examines conflict-of-law issues concerning international aspects of succession substitutes (institutions for the transfer of properties at the death of an individual other than by succession), particularly trusts. It focuses on how we can properly demarcate the scope of the law applicable to trusts and of that to succession in Japan, taking as reference the Hague Convention on trusts and German law on trusts, and whether there should be a special choice-of-law rule for succession substitutes, such as trusts, in Japan. | |||||||||||||
