| 内容記述 | ラシード・リダーが現代の「シャリーアの目的」論に及ぼした影響は極めて大きい。だが、シャリーアの目的をどのように理解するかは論者によって異なっており、彼らがリダーから受けた影響は一様ではない。人権をめぐってシャリーアの目的が論じられる場合、二つの次元での影響が認められる。一つは、人権の内容に関するものである。この次元でリダーの影響を受ける者は、信教の自由に関してイスラーム法学の革新の必要性を訴える一方、ジェンダーに関わる問題では、両性の役割の違いに関する伝統的な理解を近代西洋の形式的平等よりも優れたものとして称揚する。もう一つは、リダーの法理論からの影響である。この次元で影響を受ける者は、特にジェンダーの問題において、時代の違いを考慮した柔軟な法解釈を主張する。このように、リダーの法理論は、彼自身の解釈とは異なる解釈をも正当化し得るものであった。このことが「シャリーアの目的」論の多様化の一因となっている。 | |||||||||||

| 内容記述 | Rashīd Riḍā has a significant influence on contemporary scholars who are studying maqāṣid al-Sharī‘ah (the objectives of Islamic law). Yet these scholars have different views on maqāṣid al-Sharī‘ah, and they are not all equally influenced by Riḍā. Concerning human rights, we notice two distinct ways in which Riḍā influences maqāṣid scholars. First, some of them follow Riḍā’s view as to what rights should be guaranteed: they call for reforms of Islamic jurisprudence with regard to religious freedom, whereas, in gender-related issues, they maintain their traditional belief about the different roles that men and women should play, and consider this belief superior to the Western idea of absolute equality between genders. Second, others are influenced by Riḍā’s legal methodology: they claim that changing contexts should be considered when interpreting revealed scripture, especially with regard to gender. Thus, Riḍā’s methodology has been used to justify arguments that are against his own and has contributed to the emergence of a variety of maqāṣid theories. | |||||||||||
