| 内容記述 | 本稿では、EU指令の国内法化をめぐる近年の研究を再検討することで、その発展と課題について考察を行っている。1980年代半ば以降、EUレベルでの立法活動の活発化を背景に、成立したEU法に関して、加盟国レベルでのコンプライアンスの問題が注目されてきた。特に、指令の国内法化に際してみられる遅延や失敗といった「国内法化の不足」問題が指摘されるにつれて、行政学、法学、政治学などを専門とする研究者が中心となって、国内法化をめぐる分析が行われてきた。初期の研究では、様々な説明要因を折衷することで国内法化の分析が行われた。その一方で、欧州化研究との合流により、1990年代後半以降の国内法化研究では、適合度モデルや新制度論といった理論や方法論が重視されている。以上のように、国内法化研究の発展について概観した上で、それらの問題点と今後の課題について検討している。特に、近年の国内法化研究が用いるデータやその集積方法や定量・定性研究の間の分離といった問題を指摘している。 | |||||

| 内容記述 | The aim of this paper is to review a number of Transposition Studies including Implementation Studies and categorise them along with each research question and each dependent/independent variable. From mid-1980, a great number of EU legislations have been made in the EU level, and at the same time it has revealed that some of the member states did not necessarily comply them timely and/or correctly. Many scholars has researched the Non- Compliance issues of EU politics, which is called Transposition Deficit. While most early studies were focused on administrative and legal aspects, political scientists have recently become to realize that domestic political factors which are diverse in each country might influence the compliance performance of each European member state. The recent development on transposition studies has to do with that of new institutionalism in comparative politics. Namely some are influenced from rational choice institutionalism (e.g. veto point/player) and others are sociological institutionalism (e.g. social learning). At last after reviewing the development on transposition studies, I concluded that some methodological problems are resaved yet. | |||||
