| 内容記述 | In medieval age in Japan, Kamakura Bakufu, supported by warriors and newly coming into being in the society, made efforts to find a balance between the interests of proprietors (estate owners, e.g., Noble families, Shrines and Temples) and Bakufu's vassals. Originally, Kamakura Bakufu had responsibility to look after its vassals, however, Kamakura Bakufu was obliged to respond to the complaint of the proprietors for the vassals' unlawfulness. Kamakura Bakufu had primitive legal system in its early stage, however, Bakufu proceeded to develop it and set rules of legal procedure, and the judicial system was finally completed by the beginning of 14th century. And in the legal system, ever since the early stage, it is notable that the settlement agreement (wayo) in a case , belonged to a Bakufu court, was authorized, only after the parties applied for the approval of Bakufu court. In the process of dispute resolution in those days, the settlement agreement was used frequently, and in a sense, it might function effectively in the judicial proceedings. So, now we try to follow up some cases, which belonged to Bakufu court and reached settlements, and demonstrate the realities of wayo in the process of dispute resolution. Moreover, we will get some hints to review the significance of the trial in Medieval Japan. | |||||||||||
