review","bibliographic_titleLang":"en"}]}]},"item_1_description_12":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"本稿は、憲法政策研究のための分析枠組みを構築することを目的とする。具体的には、「憲法政策とはどのような政策か」及び「憲法政策研究にはどのような分析枠組みが有効か」という二つの問いに対する回答を導出する。第一の問いに対しては、「立憲国家における憲法と政策との関係」という観点から理論を展開した。まず、先行研究のサーヴェイを通じて、先行研究が憲法政策を立法政策に限定していることを明らかにし、その問題点を指摘した。その上で、憲法政策の意味内容を「憲法規範を憲法現実として実現するために、他の憲法規範の範囲内で実施される政策」と捉えることが適切である旨を理論的に示した。この憲法政策の意味内容は、立法政策に限定されず、行政作用及び司法作用も含まれる。第二の問いに対しては、社会科学的な因果推論の中への位置付けを念頭に、憲法政策の分析枠組みを構築した。まず、裁判所を名宛人とした裁判規範性に限らず、広く政策全般に対する規範性、すなわち政策規範性の強さという観点から憲法政策研究を行う必要性を提示した。その上で、政策規範性の強さを操作化し、比較政策的にアプローチすることが、憲法政策研究において有効な分析枠組みのひとつであることを示した。","subitem_description_language":"ja","subitem_description_type":"Abstract"},{"subitem_description":"Dieser
