| 内容記述 | 2024年ICJ勧告的意見は、イスラエルのパレスチナ被占領地における継続的プレゼンスが違法であるとし、その終了義務を示したが、法的根拠の欠如が批判されている。本稿は、長期占領の違法性をめぐる２つの見解を紹介し、いずれに依拠しても本意見を十分に説明できないと論じる。そこで、権利濫用の法理に着目した本意見の理解を提案する。さらに、本意見が長期占領の違法性に関する国際法の発展を促す可能性を指摘する。 | |||||||||||||

| 内容記述 | The OPT Advisory Opinion delivered by the ICJ on 19 July 2024 stated that "the State of Israel's continued presence in the Occupied Palestinian Territory is unlawful" and that "the State of Israel is under an obligation to bring to an end its unlawful presence in the Occupied Palestinian Territory." However, the absence of a legal basis for this conclusion has been subject to criticism. This paper introduces two views on the illegality of prolonged occupation and argues that neither sufficiently explains the Opinion. It then proposes an alternative understanding based on the doctrine of abuse of rights. Finally, it suggests that the Opinion may contribute to the development of international law regarding prolonged occupation. | |||||||||||||
