| 内容記述 | 本稿は、聴覚障害を持つ子どもAmy Rowleyに対して、手話通訳者を提供するかどうかを争ったBoard of Education v. Rowley判決を中心に、今日において障害者教育法に示される「無償かつ適切な公教育」の解釈における本判決の意義を考察し、現在の日本の状況に対して示唆を与えることを試みるものである。障害者教育法における教育を受ける権利は、このRowley判決によって一定の枠がはめられることとなった。また障害者教育法における、提供すべき教育、「無償かつ適切な公教育」の内容について、連邦最高裁が判断した例は現在に至るまで現れておらず、この判決の評価については、2006年現在においても議論の対象となっている。第1章においては、アメリカ障害者教育法成立までの過程とその内容を概観し、第2章において、Rowley判決の内容を、地裁判決から、最高裁判決まで紹介する。そして第3章では、Rowley判決に対する判決当時から、また現在に至るまでの評価の動向について論じる。そして最後に、日本における問題解決に対する一提言をもって、論を結ぶ。 | |||||||||||

| 内容記述 | This Note will focus on Board of Education v. Rowley .Amy Rowley, a deaf student, requested a sign-language interpreter from the school district and consider the meaning of this case to interpret "free appropriate public education" in the Individuals with Disabilities Education Act (IDEA). In this case, the Supreme Court took a conservative approach to the education of handicapped children. The evaluation of this case is a target of the argument even now. In first chapter, this note examines the history and contents of IDEA. In second chapter, this note examines contents of the Rowley case from the district court to the Supreme Court. In third chapter, this note examines the evaluation of this case since the judgment, until now. And at last, I make a suggestion against a solution of a problem in Japan. | |||||||||||
