However, the Czech nationality is required of the original property owners as a condition to claim the restituition. Some of the original property owners, who do not retain their Czech nationality, contend that the nationlity requirement is in violation of the non-discrimination (equality before the law and equal protection of the law) principle enshrined in Article 26 of the International Covenant on Civil and Political Rights to which Czechoslovakia is a party, and they brought the issue before the Human Rights Committee under the Covenant's Optional Protocol.
