| 内容記述 | 本論文は、今年で成立30年を迎えるアメリカ障害者教育法成立の背景について考察し、未だその30年前のアメリカにおける状況と同じであるように思われる日本の状況について、示唆を与えることを試みるものである。第2章では障害者教育法制定時、1970年代のアメリカ国内における障害者教育の状況について、当時の判例等を中心に論じる。第3章では、障害を持つ子どもに対して、教育の提供を命じることによって、教育提供のあり方について大きな指針を示し、また、障害者教育法制定に大きく影響を与えた、1972年に下された連邦地裁判決である、PARC, Mills両判決について論じる。第4章ではPARC, Millsと同時期に判決が下され、一般的に教育を受ける権利について、厳格審査は妥当しないとした、Rodriguez判決と、その判決に対する障害者の教育を受ける権利という観点からの評価について、第5章では障害者教育法成立以前の、障害者の教育を受ける権利に関する法について、それぞれ論じ、第6章ではアメリカ障害者教育法の条文の内容について解説をする。そして最後に、日本における問題解決に対する一提言をもって、論を結ぶ。 | |||||||||||

| 内容記述 | This Note is intended to explain the legislative background of the Education of All Handicapped Children Act of 1975 and to make a suggestion for the education of the children with disabilities in Japan that it thinks to be still the same as the conditions in America 30 years ago. In the 2nd chapter, it explains about the conditions of that in the U.S. in 1970's when the act was enacted by the introduction of cases at that time. In the 3rd chapter, PARC and Mills cases are argued. Those cases were the federal district court judgments given in 1972, and affected the enactment of the act. And they agreed or ordered to provide the free appropriate public education. In the 4th chapter, it explains the Rodriguez case. This is the case ordered about the same time. It was not the judgment ordered toward the children with disabilities education directly, but it affected the enactment of the act too. In the 5th chapter, it explains about the law about the right of the children with disabilities before the enactment of the Education of All Handicapped Children Act of 1975. In the 6th chapter, it explains the contents of the Education of All Handicapped Children Act. At last, I make a suggestion for the problem of the education of children with disabilities in Japan. | |||||||||||
