Russia II (2021) 10319436 0000-0003-2858-5154 DA1797173X Arai, Kyo 新井, 京 アライ, キョウ 10319436 0000-0003-2858-5154 DA1797173X Arai, Kyo 新井, 京 アライ, キョウ open access DA03093518 同志社法學會 The Doshisha Law Association 329.21 欧州人権条約 国際人道法 武力紛争法 占領 域外適用 欧州人権裁判所 ジョージア・ロシア戦争 European Convention on Human Rights European Court of Human Rights Law of Armed Conflict International Humanitarian Law Extraterritorial Application Occupation Georgia-Russian War 2021年1月21日に大法廷判決が示されたジョージア対ロシアII事件は、国際的武力紛争の状況における、ロシアおよびその支援を受けた南オセチア当局によるジョージア国民に対する様々な人権侵害について包括的に扱った国家間訴訟手続である。その判決理由には多くの問題があり、様々な批判を呼んでいる 。しかし、そこで問題点とされるものを、欧州人権裁判所のこれまでの判例の積み重ねの中で分析することにより、同裁判所が国際人権法と国際人道法との関係についてどのように理解しているかを明確にし、さらには国際人権法と国際人道法の関係に関わる議論の構造を浮き彫りにすることができる。本稿では、まずジョージア対ロシアII事件の判決の核心部分について紹介し、それに基づき判決の意義とこれまでの判例法における位置づけを分析している。 The European Court of Human Rights (Grand Chamber) Judgment of 21 January 2021 on the Georgia v. Russia II has been widely criticized but rather indicative of the long-discussed issue on the relationship between the European Convention on Human Rights and the Law of Armed Conflict, as well as the former's applicability in an International Armed Conflict.
