中国刑法における危険運転罪 : 酒酔い運転型の危険運転罪を中心に チュウゴク ケイホウ ニオケル キケン ウンテンザイ : サケヨイ ウンテンガタ ノ キケン ウンテンザイ オ チュウシン ニ Dangerous driving offences in Chinese criminal law 王, 昭武 オウ, ショウブ Wang, Zhaowu open access DA03093518 同志社法學會 The Doshisha Law Association 326.922 酒酔い運転 危険運転罪 交通事故罪 危険な方法による公共安全危害罪 抽象的危険犯 driving while intoxicated (DWI) crime of dangerous driving crime of causing traffic casualties crime of endangering public security with the dangerous method abstract dangerous crime 2011年に「中華人民共和国刑法改正案(八)」が酒酔い運転を代表とする危険運転罪を増設して以来、同罪の法的性格、交通事故罪など関係犯罪との関係、さらに酒酔い運転が一律に危険運転罪が成立するかなどの問題について、激しく争われてきていたが、以下のような結論が得られると思われる。第一に、危険運転罪は過失による抽象的危険犯ではなく、故意による抽象的危険犯である。第二に、酒酔い運転行為は危険運転罪が成立すると同時に、交通事故罪、「危険な方法による公共安全危害罪」も成立すれば、前者が後者に吸収され、後者一罪しか成立しない。第三に、刑法13条但書を抽象的危険犯である危険運転罪の認定に適用すべきで、酒酔い運転は情状によって危険運転罪が成立しないときもあることを否定できない。 Since Amendment(Ⅷ) to the Criminal Law of the People's Republic of China added crime of dangerous driving represented by driving while intoxicated(DWI), the debate over the following issues heated: the legal nature of crime of dangerous driving; the relationship between this crime and other related crimes (such as crime of causing traffic casualties); whether all driving while intoxicated should be classified as crime, and so on.
