著作物の価格形成と使用許諾および保護 チョサクブツ ノ カカク ケイセイ ト シヨウ キョダク オヨビ ホゴ Pricing, Licensing and Protection of Creative Works 神, 隆行 カミ, タカユキ Kami, Takayuki open access DA03409702 同志社大學經濟學會 The Doshisha Economic Association 331.84 著作物 保護 使用許諾 Creative Works Protection Licensing 最近のIT(情報技術)の発達により、著作物についてバックアップや編集など新たな使用方法が可能になった。これが需要曲線を右へシフトさせて使用者の便益を増大させ、また供給側にも利潤増をもたらす。すると、最初では価格を調整して最大利潤をえる。しかしながら、同時に供給側は使用者がえている便益は供給側へ帰属するものとして、この使用を不法とみなす。このために、使用許諾条件を厳しくしたり、保護を行ってこうした便益を抑制しようとする。しかし、このことは需要側の効率的な使用を抑制することになる。本稿では著作物の供給側による保護や使用許諾行動に単純なモデルで焦点を当てる。すると、その保護行動を吟味することで、使用許諾の緩和が厚生水準を高めることがわかる。 Recent progress of IT(information technology) has brought us new and more efficient ways in using creative works such as backup of software and processing of AV content by users. This means the demand curve of creative works licensing shifts to the right, with the result of bringing more benefit(consumer surplus) not only to the users of creative works but even to their suppliers. In this case, the suppliers may adjust the price of creative works for the first time, and receive maximum profits. But, they think that the benefit gained by the new uses should be returned to them, so that they, at the same time, regard the new way of using creative works as an illegal use of license. Hence, by strengthening the licensing level and/or protection of creative works, the suppliers try to use creative works efficiently. This paper will bring the suppliers' behavior of protecting and licensing creative works into focus by a simple model.
